Article 90. Obligations of Citizens, Individual Entrepreneurs, and Legal Entities
Citizens are obliged to:
Take care of preserving their health;
Comply with the regulations in force in healthcare organizations;
Undergo preventive medical examinations in accordance with the legislation of the Republic of Kazakhstan in the field of healthcare;
Follow instructions of medical workers, healthcare authorities, and healthcare organizations related to individual and public health;
Observe precautionary measures to protect their own health and the health of others; undergo examination and treatment at the request of medical organizations; inform medical personnel about their illness in cases of infectious diseases and diseases posing a danger to others.
In the event of evasion of examination and treatment, citizens suffering from diseases that pose a danger to others shall be subject to compulsory examination and treatment in accordance with this Code and other laws of the Republic of Kazakhstan.
The grounds and procedure for referring citizens suffering from diseases dangerous to others for compulsory treatment shall be regulated by this Code;
Comply with the legislation of the Republic of Kazakhstan in the field of healthcare.
Pregnant women are required to register for medical supervision before twelve weeks of pregnancy.
Foreign citizens and stateless persons staying in the territory of the Republic of Kazakhstan bear the same obligations in the field of healthcare as citizens of the Republic of Kazakhstan.
Individual entrepreneurs and legal entities, in accordance with the activities they perform, are obliged to:
Carry out sanitary and anti-epidemic (preventive) measures;
Comply with the requirements of regulatory legal acts in the field of sanitary and epidemiological welfare of the population and hygienic standards, as well as acts and sanitary-epidemiological conclusions of officials exercising state sanitary and epidemiological supervision;
Ensure the safety and quality of work performed, services rendered, and products during their production, transportation, storage, and sale to the population;
Carry out production control in accordance with the legislation of the Republic of Kazakhstan;
Timely inform state sanitary and epidemiological authorities about emergencies, production shutdowns, violations of technological processes creating a threat to the sanitary and epidemiological welfare of the population, and cases of mass and group infectious, parasitic, occupational diseases, and poisonings;
Timely inform the authorized body in cases of detecting adverse effects of medicines and medical devices;
Provide hygienic training for employees working in service sectors that pose a risk of spreading infectious and parasitic diseases to others;
Provide officials of state sanitary and epidemiological authorities with the opportunity to take samples of products, raw materials, goods, and production environments for laboratory testing within their competence;
Not allow persons without documents confirming completion of medical examinations to work, and suspend from work persons suffering from infectious diseases and carriers of infectious agents identified by healthcare organizations;
Not permit the sale of goods, products, or raw materials found not to comply with regulatory legal acts in the field of sanitary and epidemiological welfare and hygienic standards, and decide on the possibility of their use or disposal;
Possess a sanitary passport;
Submit accounting and reporting documentation related to sanitary and epidemiological welfare issues to state sanitary and epidemiological authorities for inspection;
Suspend entrepreneurial and/or other activities in cases where they create a threat to the life or health of the population;
Ensure unhindered access for officials carrying out state sanitary and epidemiological control to facilities for the purpose of checking compliance with regulatory legal acts in the field of sanitary and epidemiological welfare and hygienic standards;
At their own expense, carry out disinfection, disinsection, and deratization measures for epidemiological indications and in accordance with instructions and resolutions of sanitary and epidemiological service officials.
Article 92. Obligations of Patients
In addition to the obligations specified in Article 90 of this Code, the patient is obliged to:
Take measures to preserve and strengthen their health;
Show respect and tact in communication with medical personnel;
Provide the doctor with all information necessary for diagnosis and treatment of the disease, and after giving consent to medical intervention, strictly follow all instructions of the attending physician;
Observe internal regulations and treat the property of the medical organization with care, and cooperate with medical personnel while receiving medical care;
Timely inform medical personnel about changes in their state of health during diagnosis and treatment, as well as in cases of occurrence or suspicion of diseases dangerous to others;
Not commit actions that violate the rights of other patients;
Fulfill other obligations предусмотренные законами Республики Казахстан.
The obligations of patients specified in subparagraphs 2)–4) of paragraph 1 of this article also apply to parents or other persons directly caring for a sick child in an inpatient facility.
